Burlington County Family Division Court

The Family Division for Burlington County is on the first floor of the Burlington County Court Facility at 49 Rancocas Road in Mount Holly. The court is open Monday through Friday, 8:30 AM to 4:30 PM.

Burlington County has separate units for each type of family court case. The Dissolution Intake unit handles new divorce filings. The Non-Dissolution unit takes custody, support, and paternity cases filed outside of divorce. There are also units for domestic violence, juvenile cases, and child abuse and neglect matters. A mediation and parent education unit helps families work out disputes before trial in Burlington County.

How to Search Burlington County Records

You can search family court records in Burlington County through the NJ Courts Find a Case tool. This free tool lets you search civil cases by name or docket number. Burlington County uses code "03" in its docket numbers. A typical format is FM-03-07500-14, where FM means family matrimonial, 03 is the county code, and 14 is the year filed.

To search in person, visit the Court Facility at 49 Rancocas Road in Mount Holly. Bring a photo ID. The Dissolution Intake office can also be reached by phone at 609-518-2645. If you do not have a docket number, contact the Customer Service Unit at 609-421-6100. They can help you find your case in the system. The Judiciary Electronic Document Submission (JEDS) system lets you submit court forms online at any time, which can save a trip to the Burlington County courthouse.

Family Cases Filed in Burlington County

The Family Division in Burlington County handles divorce, child custody, child support, domestic violence, juvenile delinquency, guardianship, adoption, and paternity. Divorce cases follow the rules in N.J.S.A. 2A:34-2, which allows both fault and no-fault grounds. Under N.J.S.A. 2A:34-10, at least one spouse must have lived in New Jersey for 12 months before filing on no-fault grounds.

Child support cases in Burlington County are tracked through the statewide system. Call 877-655-4371 for support questions. Domestic violence restraining orders can be filed at any time. During court hours, go to the Family Division at the Court Facility. After hours, contact local police. Juvenile records in Burlington County are not public under N.J.S.A. 2A:4A-60. Adoption records are sealed under N.J.S.A. 9:3-52.

Burlington County Court Fees

Filing a divorce in Burlington County costs $300. A $25 pro se surcharge applies if you have no lawyer. Motions are $15. Post-judgment motions cost $30. These are standard state fees.

Getting copies of family court records in Burlington County has its own costs. Plain copies are $0.05 per page for letter size. Certified copies cost $15 per document. The Seal of the Court adds $10. A certified copy of a divorce judgment is $25 for the first copy, with extra copies at $2 each. Pay by check or money order to "Treasurer-State of New Jersey." The court accepts cash in person only. Credit cards work for electronic submissions.

Public Access to Burlington County Family Court Records

Most family court records in Burlington County are open to the public under N.J.S.A. 47:1A-1. Anyone can ask to see them, even if they are not part of the case. But certain records have limits on access. Domestic violence files are sealed under N.J.S.A. 2C:25-33. Juvenile records are kept private. Adoption files need a court order. Financial data in divorce cases may be blacked out in public copies.

Divorce documents will only be given to a party, their attorney, or someone with a court order. Rule 1:38 of the New Jersey Court Rules sets out all the access rules.
